12.Contract Terms & Authorizations - customer invoice

 

AUTHORIZATION TO PROCEED
By signing the invoice/contract, I certify that I am the owner, authorized representative, or tenant of the property where the listed work is to be performed. I authorize Hydro Rooter & Plumbing to complete the recommended services using the labor and materials deemed necessary.

A monthly service charge of 1.5% will be added to any unpaid balance. If a check is returned, I understand I may be liable for three times the amount of the check plus any related court costs. I agree to pay reasonable attorney’s fees and court costs in the event of legal action.

I acknowledge that I have read and agree to all Terms and Conditions. I have received a copy of this contract and the Notice to Owner. All removed parts will be discarded unless otherwise noted.

If a complaint cannot be resolved directly with Hydro Rooter & Plumbing, it must be filed within the time period required under A.R.S. § 32‑1155(A).

PAYMENT AUTHORIZATION
Payment for this invoice/contract is due upon completion of work.
I authorize Hydro Rooter & Plumbing to proceed with the work at the agreed contract price.

I may cancel this transaction without penalty prior to the start of work.

ACCEPTANCE OF WORK PERFORMED
Upon completion, I acknowledge that all services and materials have been provided in a satisfactory manner. I agree that the amount listed on this invoice/contract represents the full and complete contract price/minimum charge. Full payment is due upon completion.

I agree to pay reasonable attorney’s fees and court costs in the event of legal action. I acknowledge receipt of a legible copy of this contract, the Notice to Owner, and all required disclosures.

CANCELLATION POLICY
Once a work order is approved and signed:

Cancellations made less than 48 hours before the scheduled start may incur a fee up to 10% of the contracted price.

Cancellations made less than 24 hours before the start of work, or after work has begun, may incur a fee up to 25% of the contracted price plus the cost of purchased materials.

Jobs canceled due to unforeseen or exceptional circumstances may be rescheduled to avoid fees.

Cancellation fees will be deducted from the initial deposit.

In the event of legal action regarding cancellation fees, the client agrees to be responsible for all associated costs.

A minimum down payment of 50% of the total quoted price is required prior to the start of work.

DISCLAIMER
Drain Cleaning: Hydro Rooter & Plumbing is not responsible for damage to pipes that were already weak, brittle, or compromised prior to cleaning.

Pipe Connections: Connections will only be made to existing pipes that are in sound and proper condition.

Down Payment: A minimum down payment equal to 50% of the total quoted price is required before work begins.

Please note the key terms, responsibilities, and policies that apply to all services performed by Hydro Rooter & Plumbing. By approving the invoice or allowing work to begin, the customer agrees to the following conditions.

1. Warranty Overview
Hydro Rooter & Plumbing warrants its workmanship to be free from defects for 2 years from the date work is completed. Warranty claims must be submitted in writing within the warranty period.

No warranty applies to drain cleaning, jetting, or services performed on aged, corroded, root‑intruded, or compromised plumbing systems.

Warranty coverage is limited to repair or replacement of the affected work. Incidental or consequential damages are not covered.

2. Service Warranty Policy
Hydro Rooter & Plumbing provides:

30‑day labor warranty on workmanship

Manufacturer warranties on installed parts when applicable

Warranty does not cover pre‑existing issues, misuse, foreign objects, grease, wipes, root intrusion, or problems caused by customer‑supplied parts.

Customers requesting warranty service must provide name, service address, date of service, and a description of the issue.

3. Customer Responsibilities
Customers must provide:

Safe access to work areas

Water and electrical power

Dry, accessible work conditions

Secured pets and safe surroundings

Customers must follow all instructions regarding water shut‑offs, fixture use, and system operation.

4. Hidden Conditions & Existing Systems
Plumbing systems may contain hidden defects that cannot be identified prior to work. Pricing is based solely on the agreed‑upon scope. Additional work required due to unforeseen conditions will be billed at the contracted rate.

Hydro Rooter & Plumbing is not responsible for the condition or performance of existing plumbing systems not installed by the company.

5. Underground Utilities
Hydro Rooter & Plumbing is not responsible for damage to unmarked or improperly installed underground utilities, irrigation lines, or plumbing lines. Customers must provide accurate information when available.

6. Environmental Discoveries
If hazardous materials, contamination, sewage, mold, or unsafe conditions are discovered, work will be suspended until remediation occurs.

Hydro Rooter & Plumbing is not responsible for testing, remediation, or disposal of hazardous materials.

7. Plans, Diagnostics & Field Conditions
All customer‑provided plans or diagrams are subject to field verification. Additional labor or materials required due to inaccurate information will be billed accordingly.

8. Elevations, Grades & Drainage
Hydro Rooter & Plumbing is not responsible for pre‑existing drainage issues, improper grading, or structural conditions affecting plumbing performance.

9. Change Orders
Any change to the scope of work must be documented in writing and signed by both parties. Additional work is billed on a time‑and‑material basis unless otherwise agreed.

10. Mechanic’s Lien Rights
Hydro Rooter & Plumbing may file a preliminary lien notice as required by Arizona law. This is standard procedure and not a reflection of customer standing.

11. Scheduling & Delays
Completion timelines may be affected by weather, emergencies, material shortages, inaccessible work areas, or customer‑caused delays.

12. Attorney Fees & Venue
If legal action is required, the prevailing party is entitled to reasonable attorney fees. Venue is Pima County, Arizona.

13. Interest & Collections
Unpaid balances accrue 1.5% interest per month.

Customers are responsible for all collection costs, including administrative fees, court fees, attorney fees, and post‑judgment enforcement.

Returned payments incur a $35 fee plus bank charges.

14. Default & Legal Remedies
A customer is in default if payment is late, a payment plan installment is missed, or a payment is reversed.
Hydro Rooter & Plumbing will issue:

A 7‑day Notice of Default

A 48‑hour Final Demand

before initiating legal action.

15. Liability Waiver
Customers acknowledge that plumbing systems may contain hidden defects and that pre‑existing conditions may worsen during service.

Hydro Rooter & Plumbing is not liable for water damage, mold, structural issues, or failures caused by aging systems, customer‑supplied parts, or third‑party work.

Liability is limited to the cost of the service performed.

16. Refund Policy
Refunds may be issued only when:

-A service was paid for but not performed

-A duplicate payment was made

-A recommended service is determined unnecessary

-A billing error occurred

Refunds are not issued for completed labor, diagnostics, trip charges, customer‑supplied parts, or services affected by pre‑existing issues.

Deposits become non‑refundable once work begins or materials are purchased.

Refund requests are reviewed within 5–7 business days.
